The website www.en.natalys.com (hereinafter the "Website") is a service of NATALYS, a société par actions simplifiée [simplifed joint stock company] with capital of 1,903,312.00 euros, registered as company number 652 050 832 with the Trade and Companies Register of Bobigny, with intra-community VAT number FR68 652 050 832 and headquarters located at 49/51, rue Emile Zola, 93100 Montreuil, France, represented by Mr. Paul Zemmour.

The Website is developed by the company OSF Global France S.A.S.U. [simplified joint stock company with sole shareholder], with headquarters located at 12 place de la Défense, Maison de la Défense, 92974 Paris La Défense Cedex, France, registered as company number B 750 118 895 with the Trade and Companies Register of Nanterre, represented by its chairman, Gerard Szatvanyi.

"User": this term refers to any non-trading natural person over 18 years of age accessing the Website and/or using the Website's features;

"Website": this term refers to the website www.en.natalys.com.

In the event that one of the clauses of these TOU is rendered null and void by a change in laws or regulations or by a court decision, the validity and compliance with these TOU shall in no way be affected.

ARTICLE 11: Waiver

In the event that, at a given moment, the Publisher does not invoke any one of the clauses herein, this does not constitute a waiver of its right to invoke those same clauses at a later date.

ARTICLE 12: Personal Data Collection

The Publisher collects, uses, stores, and transmits certain personal data provided by the Customers in strict compliance with French data protection law, in particular the provisions of Law No. 78-17 of January 6, 1978, known as the "Information Technology and Civil Liberties Act," and those of Regulation (EU) No. 2016/679 of 27 April 2016, known as the General Data Protection Regulation.

The Publisher accounts for these provisions, and for Users' rights, under the "Privacy Policy" tab on the Website.

By accepting these TOU, the User agrees that the Publisher, in its capacity as data processor, processes his/her data in order to perform this contract. These data are stored only as long as necessary to achieve the objective in pursuit of which the data were collected, unless otherwise provided by law. The data can be communicated only to the Publisher's internal departments and to service providers acting in the interest of the previously described purpose.

The User has a right of access, rectification, objection, and deletion of data. To exercise these rights, please send a letter specifying your request and attach proof of identity.

ARTICLE 13: Changes to the TOU

The Publisher reserves the right to amend the content of these TOU, unilaterally and at any time. The amended TOU enter into force upon publication on the Website. For this reason, the Publisher encourages the User to review the TOU on a regular basis. The User is notified that the latest version of the TOU will govern his/her access to and/or use of the Website. The User agrees to claim no compensation in the event of the interruption, suspension, or amendment of these TOU.

The TOU can be sent, free of charge, to any person addressing such a request to Customer Service (see contact information below).

ARTICLE 14: Period of Validity

These TOU are valid for an indefinite period. They take effect with regard to the User upon access and/or use of the Website.

ARTICLE 15: Applicable Law and Competent Courts

These TOU are governed by French law and will be interpreted accordingly, without prejudice to any other preponderant, mandatory rule in force in the Customer's country of usual residence.

The language of these TOU is the French language.

In the event of any dispute, French courts will have sole jurisdiction. Any dispute arising from the application, interpretation, or execution hereof, or related to the use of the Website or to any purchase made through the Website, will be brought before the Courts of the Client's legal residence, or else before the courts of Bobigny, regardless of the place of Order, delivery, or payment, or the payment method, even in the case of warranty proceedings or multiple defendants.

The Website is compliant with French law. If the User accesses the Website from another country, the Publisher offers no guarantee of compliance with any applicable local laws.
